My immediate suggestion is to return Spore and get a brand new disc. A simple swap on the grounds of a defective disc.

hmm that is a little problem i am from serbia (balkan ex Yugoslavia) and i by this game in USA.
so ther is no way to get this cd back...

there is no other way ?

I suppose you could try to manually install the game. See if it would let you copy the files to your hard drive and let you install from your hard drive, while having the install DVD inside your Optical Drive.

And this is a legit copy of Spore, correct?

Yes. i buy i USA in pc shop full closed (one word new)

The last idea i have is cleaning the CD. Or trying installing in a different computer with a DVDROM

Clean the CD using a soft, clean cloth. Use a bit of water and wipe outwards. Then try installing again.
