The hosting page looks quite the same as on simgames.net, but why would we care...
things like this happen all over the internet, I'm not worried about it.
    it's only a look-a-like

Still sucks though. That people can't even spend the time to come up with thier own style.

FWIW, the folks at MaxisGamer have been stealing the content from our site for as long as I can remember. Fortunately, they're completely incompetent, and delete everything and start over every couple months, so no one in their right mind would ever host with them. I don't know why they keep bothering.

I could certainly submit an abuse complain to their ISP, but they aren't really worth the effort. :)

    FOR YOUR INFORMATION

    1) Maxisgamer.net did not rip off your design, if you look carefully, the coding is no way the same, and I have had 4 different people look at it to varify it.

    2) I have had most of my content on floppy disks for over 5 years now. (Since the beginning)

    3) Yes we can come up with our own styles, I designed the site with my own sweat and my own blood and hard work.

    4) You got to need glasses to think the site is the same, as there are actual differences

    5) my members page was down as i was still building it.

    6) We have not been knicking Simgames.net's content for years, that is a dirty lie.

    7) I have designed a new design to stop you all wining as i am sick to death of it and I better not hear any more nasty or slanderous comments about my site as it is doing my head in, just leave me and my site alone! also i suggest as this topic is slanderous, who ever is in charge here deletes this topic.

    kindest regards

PS: I will say this, that i now have members and are slowly gwowing, just because certain ppl have it in for my site since alec died, no need to gloat and make my life a missery. :(

Yea looks like... doesnt mean it is the same does it?

The reason I changed my site design was because of the flack you people were giving me and now it is continuing. The comments in this topic are actually slanderous and not very nice in my oppinion. Maxisgamer.net have not nor ever have stolen anything and the design was hand made, look at the coding, completely different.

Also the logo, I drew that myself in Paint, not knicked it, drew it. Anyway what is the problem with you lot?

You have been posting slanderous comments about my site in a forum which if I am right, breaches the TOS of this script.

Clearly also your modorators are not doing their job but joining ionm hurting my and my team of staff, that through all we have been through, are still standing here providing a service and you lot just want to wipe your feet all over us.

I am sorry, but enough is enough. I am now going to seek legal advice on this issue. I am fed up to the back teeth of being walked over by this website and the people posting in this forums. I am just a guy that wants to share hosting for gamers. I am autisitic and there is no need to get me really upset about this. I am really angry because you guys think is is fun to pick on me. YOU ARE A BUNCH OF BULLIES, picking on someone with a disability and should be ashamed of yourselves. Dont bother appologising, it's too late. [/u]

    Isn't this fun?

I like the use of the disability "card" to create sympathy for your disregard for our intellectual property. Since I wrote most of the text on this site, I quite well recognize it when I see it elsewhere.

When I have, at least a half dozen times, browsed your site and recognized slightly reworked copies of my own work on a design layout I laid out (but with such horrifying HTML added to the mix), and chosen to ignore it because you weren't worth my time, you might have assumed I didn't notice. To make matters worse, I did at one time contact Alec to have just such a problem corrected and it was taken care of briefly followed by exactly the same thing again.

You have been doing this for years, and Alec before you, and what's been said here is certainly neither slander nor libel when it is true, which it is, and if you're serious about suing us, let us know so I can prepare a few years of evidence for you... and let me assure you, the marvelous reality is that I can dig up more evidence against you than you can possibly imagine. However, I see no reason to bother wasting my time, and I'd strongly recommend you not waste any more of your own.

I would, likewise, appreciate never seeing a piece of content stolen by you from our site again, but since you have proven that you do not have the creativity to even write your own text, I will not be surprised next time you completely relaunch and copy whatever design we have at that time, content and all. And unless you make yourself a nuisance, I will probably do nothing more than let other people make fun of you. If you want to make an issue out of it, I'll be happy to have a discussion with your hosting provider.

    To those curious:

It is correct to say that Alec was hosted here at one time. Even at that time they copied much of our content trying to run a hosting network. We had basically allowed this sort of thing, as we wanted to be sure that the terms were accurately represented on member sites that were hosting other people. When MaxisGamer did finally depart from our hosting, they took much of our content with them, which is the reason I had requested Alec remove it. I continued to periodically watch the site and saw many iterations of site design, always remarkably similar to the current SimGames.net design and containing nearly identical content. They've since moved away from taking our text verbatim and now reword it so as to differentiate themselves from us by different wording.

They have always kept a list of empty categories on their members page because they've never hosted more than 5 to 10 sites at any given time, most seeming to be personal sites of friends and staff. I am unsure whether they've ever had any users sign up for hosting service, but it is certainly something I would avoid given what I had seen happen to their member sites while they were hosted with us.

I have never given them a particularly hard time because they were not, are not, and never will be a threat to SimGames.net. They are certainly not welcome back to our hosting due to this behavior, though I know it had been requested on at least one occasion. To be honest, this situation has always amused me a bit. Though I must also admit I've always felt a bit sorry for them as well, as they've never even managed to benefit from stealing my work, as best I can tell.

After a quick review of the sites, I say: Go ahead, sue us... Nothing that has been stated is false, that I can tell. Let me give a couple examples...

Let me see, the front page of your site, first line:
Maxisgamer.net! have been providing webhosting to the gaming community for 5 years now.

Our site from a few years ago:
SimGames.net has been providing free hosting to the gaming community for over three years.

It wouldn't be that odd if it were in a different placement, but both being the first line on the site? Adding the grammar error doesn't really help you either...

    Our free hosting page:
SimGames.net has three classifications of hosting, subdomain hosting and two levels of domain hosting. ... however domain hosting requires that you first acquire the domain name through a registrar. The Level 2 domain hosting is not available immediately upon signup unless your site already meets the establishment requirements.

    Your free hosting page:
Maxisgamer.net has three levels of hosting. However, Level 1 and 2 Domain Plans require you to first purchase a domain from domain registrar. Level 2 hosting is not available on sign up. This plan requires you prove that your site is established first.

First line on the members page of Simgames.net:
SimGames.net is host to many popular sites in the gaming community

    of MaxisGamer:
Maxisgamer.net is host to many gaming sites in the gaming community

You're telling me you didn't rip our text??

Now the help section. The sections we have:
    General Site Management
    Database Management
    Scripting Support
    Hosting Subaccounts
    Miscellaneous Information

That is enough proof right there to say that what is being said has merrit and cannot simply be said to be untrue. In order to have any case of libel or slander, you would need to prove that what was said was false... From what I can tell, no one has accused you of stealing our actual code, just the look, feel, and content of the site, which seems to be fairly accurate... Yes, most of the text isn't word-for-word anymore, but you can definitely tell where the text from your site came from.

Also, the site design now is a bit similar to SimGames.net from 2002 with the system status, etc.: http://web.archive.org/web/20020125092759/www.simgames.net/

Wish I could have seen your old design... Also, don't worry, we have saved your whole site on our servers, in case that is ever needed for "evidence," so deleting it now would be fruitless.

Also, the email you sent threatening legal action and informing us that you contacted our "host" was hilarious... Number one, I would just love to see you get a lawyer to process an international libel case when we an backup what was said, as is shown above. Next, you contact Equinix, our "host" and I am sure they could care less. That is like telling my landlord that I occassionally look at porn. They provide us space, nothing else. We don't even have much space with them anymore, as we're located mainly on the 2nd floor of the same building and we operate our own network, our own switches, etc. I can get you our new landlord's information as well, if you want it...

Sorry to tell you buddy, but we're the real deal, you're not. We're right, and you're wrong. Update your site and we won't contact our lawyers about you ripping our site... Oh yeah, unlike you, we actually have lawyers on retainer already. Haha, sorry, just thought that would be a fun way to end. Honestly, you're not even worth the time or money I would spend on just giving my lawyer a call.

    Aaron/Paul:

We've been more than gracious hosts (in terms of a hosting member and member of this community) but there is a line you do not want to cross with me.

I've been well aware of your actions and I myself considered taking legal action for replicating our design updates. Needless to say, Chris and I were not that happy that you did so and we felt it best to leave you alone to give you the benefit of the doubt to distance yourself away from the design created.

Now both of you have the audacity to call us thieves and con artists? Careful where you tread. You aren't just dealing with Steadfast, Kevin, and Karl. You also have Chris and myself to contend with and we're not afraid of taking necessary measures to protect SimGames.net

If you want to cite your health reasons as your primary source of your actions, certainly one in your condition wouldn't have the rationale to properly threaten legal action.
